Services
MCB Construction provides a range of services including, but not limited to, construction projects, steel fabrication, TMT sales, cement sales, automation shutters, rolling shutters, and centering rental. All services are subject to availability and may be withdrawn or changed at our discretion.
Quotations and Contracts
Quotations: All quotations provided are valid for 30 days unless otherwise stated. After this period, prices and terms are subject to change.
Contracts: A contract is formed only when MCB Construction confirms in writing that we accept your order or project proposal. The terms of each contract are governed by these terms and any specific terms agreed upon in the contract.
Payment Terms
Invoices: Invoices will be issued at agreed milestones or upon completion of the work.
Payment: Payment is due within 30 days of the invoice date unless otherwise specified in the contract.
Late Payments: Late payments may incur interest at a rate of 2% per month.
Delivery and Performance
Delivery Dates: All delivery and completion dates are estimates. While we strive to meet these dates, MCB Construction is not liable for delays beyond our control.
Performance: Our performance of services will be as described in the contract. Any changes to the scope of work must be agreed upon in writing and may incur additional costs.
Warranties and Guarantees
Quality Guarantee: MCB Construction guarantees that all services and products will meet the specifications and standards agreed upon in the contract.
Defects: Any defects must be reported within 14 days of delivery or completion of the work. MCB Construction will, at its discretion, repair, replace, or refund the defective item or service.
Liability
Limitations: MCB Construction’s liability for any claim arising out of the performance of our services is limited to the amount paid by the client for those services.
Exclusions: MCB Construction is not liable for indirect, incidental, or consequential damages arising from the use of our services.
Client Obligations
Access and Permits: The client must provide access to the site and obtain any necessary permits or approvals required for the work.
Site Conditions: The client must ensure that the site is safe and ready for the commencement of work.
Confidentiality
Both parties agree to keep all information exchanged during the performance of the contract confidential and not to disclose it to any third party without prior written consent.
Termination
For Convenience: Either party may terminate the contract for convenience with 30 days written notice.
For Cause: Either party may terminate the contract immediately if the other party breaches any material term of the contract and fails to remedy the breach within 14 days of notice.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of State of Tamil Nadu. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of State of Tamil Nadu.
Amendments
MCB Construction reserves the right to amend these terms and conditions at any time. Any changes will be posted on our website and will take effect immediately upon posting.
